How do I complete the Wellbeing and Disability - Data Consent Agreement?

Before you have an appointment with a Disability Adviser, you need to agree to a Data Consent Agreement, agreeing that the Disability Service can store your information and share relevant information with appropriate staff and external agencies (please note: If you do not give consent to share information, the support which can be provided may be restricted).

Disclosure:

• The University uses and collects your personal data in accordance with data protection laws. Full details outlining the University’s use of personal data is available from http://uso.southwales.ac.uk/ig/dp/

• You have the right to withdraw consent, access or request deletion of your personal data held by the above named services at any time by contacting the Data Protection Officer - dataprotection@southwales.ac.uk

The Wellbeing and Disability Service will confidentially and securely, store your personal and sensitive data for the purposes of identifying and communicating appropriate reasonable adjustments under the Equality Act (2010), co-ordination of support services, service monitoring, evaluation and improvement.

What data will be held?

• student identity and personal contact information.

• information about the nature of your disability / difficulty and related support requirement (i.e. medical documents, diagnostic reports and Disabled Students Allowances (DSAs) documentation).

• records of correspondence and appointments between Wellbeing and Disability Service staff and yourself / other relevant parties in relation to your support requirements.

• records of support provided to you by the Wellbeing and Disability Service (e.g. timesheets, invoices, booking confirmations and work plans).

What information will be shared?

Your information will be treated as sensitive and confidential, except in exceptional circumstances(1). However, (with your consent) it may be necessary to exchange some information with appropriate internal and external stakeholders to establish your support requirements, implement reasonable adjustments and co-ordinate your support. This may include:

• part B of your Individual Support Plan (ISP) being communicated to your Faculty and other appropriate University Staff to ensure that reasonable adjustments are implemented and your support requirements met.

• exchanging information with the Student Support Fund and Assessors in order to facilitate a diagnostic assessment for Specific Learning Difficulties (if applicable).

• exchanging information with your Funding Authority, Needs Assessor and Non-Medical Help suppliers in order to facilitate your application for Disabled Students Allowances (DSAs) and manage your DSA support (if applicable).This will include exchanging information with nominated agents of your Funding Authority for quality assurance purposes.

• exchanging information with other departments within the University in order to facilitate your access to advice and guidance from other specialist areas (as appropriate) (e.g. Student Money Advice, Progression Advice, Careers etc.).

• consulting with other external professionals involved in providing support services to you (e.g. GP, Community Mental Health Practitioners, personal care providers etc.).

Enhanced Disclosure:

Details of students’ disabilities / conditions are not routinely included in Individual Support Plans (ISPs) or shared with other University staff. Information about your disability can be included in your ISP at your request.

If you would like to make an enhanced disclosure we will need your agreement. An Adviser will then contact you to discuss and agree the level of information to be included before your ISP is shared. 

Disclosure of information to Family Members:

The Wellbeing and Disability Service will not share your sensitive personal data or discuss your support with family members without your explicit consent (except in exceptional circumstances (1).

If you wish to give consent for the Wellbeing and Disability Service to discuss your circumstances with a nominated individual (e.g. a family member), you will need to discuss this with your Adviser and provide separate explicit written consent.

Terms and conditions of support: 

• to provide suitable evidence of your Disability in order to establish your support requirements.

• to collaborate with staff in applying for DSA or other relevant funding to cover the cost of support provided.

• to notify staff of any changes to your circumstances which are likely to have an effect on your support.

• to adhere to the cancellation / absence procedures for all support received.

• to provided confirmation of support received in a timely manner.

• recordings of academic sessions made whilst studying at the University may be used for your own personal study purposes only. You may not reproduce, abuse, publish or share recordings with others. Misuse of academic session recordings will lead to disciplinary action against you and possible expulsion from the University.

We reserve the right to withdraw certain aspects of support where the above terms and conditions are not adhered to. If staff have concerns relating to your ability to successfully engage with your studies we will raise them with you as soon as possible with the intention of refining support or assisting you to make other changes. However, responsibility for your education will firmly remain with you and your choices and preferences will be respected.

(1) where: you are putting yourself or others at some serious risk; your behaviour is adversely affecting the legal rights of others; staff are being placed in a position where their professional integrity is compromised; disclosure is required by law.
